The Telangana Shops and Establishments Act, 1988
The Telangana Shops and Establishments Act, 1988 and the Telangana Shops and Establishments Rules, 1990 apply to shops and commercial establishments in the areas of Telangana notified by the State Government. They regulate wage payment, terms of employment, hours of work, rest intervals, overtime, opening and closing hours, closed days, holidays, leave, maternity benefit, working conditions, the employment of children, and the records an employer must keep.
Key Definitions
- Shop: premises where trade or business is carried on or services are rendered to customers, including shops run by co-operative societies and the offices, storerooms, godowns, warehouses and workplaces used for that trade. Commercial establishments are not shops.
- Commercial establishment: an establishment carrying on a trade, business or profession, including the clerical department of a factory; commercial, trading, banking and insurance establishments; establishments of co-operative societies; and factories that fall outside the Factories Act, 1948. Shops are not commercial establishments.
- Establishment: a shop, commercial establishment, restaurant, eating house, residential hotel, lodging house, theatre or other place of public amusement or entertainment, and any other establishment the Government brings under the Act by notification.
Registration of Establishments
- An establishment that existed when the Act came into force had to register within 30 days of that date. A new establishment must register within 30 days of starting work.
- The employer sends the Inspector a statement (Form I) with the prescribed fee. The Inspector registers the establishment and issues a certificate of registration (Form II), which must be displayed prominently.
- Applications are made online. Once the application and its enclosures are uploaded, provisional registration is granted within 24 business hours and stays valid until a final order is passed.
- If the Inspector passes no adverse order within 30 days of the statement being submitted, the registration is treated as granted. No inspection is needed before registration.
- The certificate is valid from the date of issue until 31 December of that year, and is renewed on application (Forms III and IV).
Changes and Closure
- Any change in the registered particulars must be reported to the Inspector (Form VII) within 15 days. The Inspector updates the register and amends or reissues the certificate.
- When an establishment closes, the employer must inform the Inspector in writing within 15 days. The Inspector removes it from the register and cancels the certificate.
- The Inspector can also remove an establishment and cancel its certificate without notice from the employer, once satisfied that it has closed.
