Uttarakhand Draft Rules for the Industrial Relations Code

The Uttarakhand government notified the Draft Rules for the Industrial Relations Code in the gazette on 25 February 2021.

Applicability

Once in force, the Draft Rules will apply across the whole of Uttarakhand, for industrial and commercial establishments where the State Government is the appropriate Government, effective from the date of publication in the Official Gazette. They will repeal four existing regulations:

  • Uttar Pradesh Trade Union Regulations, 1927
  • Uttar Pradesh Industrial Employment (Standing Orders) Rules, 1946
  • Industrial Disputes (Uttar Pradesh) Rules, 1958
  • Industrial Tribunal and Labour Courts Rules of Procedure, 1967

Compliances

The Draft Rules prescribe twenty-two forms covering procedures under the Code:

  • Form A – Memorandum of settlement reached during conciliation, or between employer and workers outside conciliation proceedings (Rule 2)
  • Form B – Application for trade union registration (Rule 10(1)(a))
  • Form C – Register of trade unions (Rule 11(1))
  • Form D – Certificate of trade union registration (Rule 11(2))
  • Form E – Application for withdrawal or cancellation of a certificate of registration (Rule 27(1))
  • Form F – Annual return for the year ending (Rule 28(1))
  • Form G – Register of certified standing orders (Rule 37(1))
  • Form H – Application for modification of an existing standing order (Rule 38)
  • Form I – Notice of an employer’s proposed change to service conditions (Rule 39)
  • Form J – Notice of an employer’s proposed change to service conditions (Rules 40 & 42(3))
  • Form K – Authorization for representation before the authority (Rules 42 & 61)
  • Form L – Oath of office for a Judicial or Administrative Member of the State Industrial Tribunal (Rules 43(21) & 44(21))
  • Form M – Application to the Tribunal for matters unresolved by the Conciliation Officer (Rule 45(5))
  • Form N – Summons (Rule 45(10))
  • Form O – Registration of settlement (Rule 45(35))
  • Form P – Certificate of registration (Rule 45(35))
  • Form Q – Notice of strike by a union or group of workers (Rule 46)
  • Form R – Notice of lock-out by an employer (Rule 47)
  • Form S – Notice of retrenchment or closure to the State Government under Chapter IX (Rules 48 & 50)
  • Form T – Application for permission of lay-off, continued lay-off, retrenchment, or closure under Chapter X (Rules 51, 53 & 55)
  • Form U – Notice to an employer for a first-time offence, for compounding under Section 89(4) (Rule 58(1))
  • Form V – Complaint under Section 91 of the Code (Rule 60(i))
