The Punjab government notified the Draft Rules for the Industrial Relations Code in the gazette on 5 March 2021.
Applicability
Once in force, the Draft Rules will apply across the whole State of Punjab, effective from the date of their publication in the Official Gazette.
Compliances
The Draft Rules prescribe twenty forms covering procedures under the Code:
- Form I – Memorandum of settlement reached during conciliation, or between employer and workers outside conciliation proceedings (Rule 3)
- Form II – Application for trade union registration (Rule 8)
- Form III – Register of trade unions (Rule 10(1))
- Form IV – Certificate of trade union registration (Rule 10(2))
- Form V – Notice of change of name (Rule 13(1))
- Form VI – Notice of amalgamation of trade unions (Rule 13(2))
- Form VII – Notice of dissolution of a trade union (Rule 14)
- Form VIII – Annual returns (Rule 16)
- Form IX – Register of membership and subscription (Rule 22(1))
- Form X – Notice of an employer’s proposed change to service conditions (Rule 32)
- Form XI – Agreement for voluntary arbitration (Rule 33)
- Form XII – Authorization for representation before the authority under the Code (Rules 35, 54 & 55)
- Form XIII – Oath of office for a Judicial or Administrative Member of the Industrial Tribunal (Rules 36(21) & 37(21))
- Form XIV – Application to the Tribunal for matters unresolved by the Conciliation Officer (Rule 38(5))
- Form XV – Notice of strike by a union or group of workers (Rule 39)
- Form XVI – Notice of lock-out by an employer (Rule 40)
- Form XVII – Notice of retrenchment or closure to the State Government (Rules 70(c), 41 & 43)
- Form XVIII – Application for permission of lay-off, retrenchment, or closure under Chapter X (Rules 44, 47 & 49)
- Form XIX – Notice to an employer for a first-time offence, for compounding under Section 89(4) (Rule 52(1))
- Form XX – Complaint under Section 91 of the Code before the Conciliation Officer, Arbitrator, or Industrial Tribunal (Rule 53(1))
