Draft of Industrial Relation (Jharkhand) Rules, 2021

The Jharkhand government notified the Draft Rules for the Industrial Relations Code in the gazette on 14 July 2021.

Applicability

Once in force, the Draft Rules will apply across the whole of Jharkhand, for industrial establishments and matters where the State Government is the appropriate Government, effective from the date of publication in the Official Gazette.

Compliances

The Draft Rules prescribe nineteen forms covering procedures under the Code:

  • Form A – Application for trade union registration (Rule 7)
  • Form AA – Application for recognition of a State trade union (Rule 20(1))
  • Form AAA – Application for recognition of a State federation of trade unions (Rule 20(2))
  • Form B – Register of trade unions (Rule 8)
  • Form C – Certificate of trade union registration (Rule 9)
  • Form D – Notice before withdrawal or cancellation of a certificate of registration under Section 9(5) of the Code (Rule 12(2))
  • Form E – Annual returns (Rule 33)
  • Form I – Memorandum of settlement reached during conciliation, or between employer and workers outside conciliation proceedings (Rule 2)
  • Form II – Notice of an employer’s proposed change to service conditions (Rule 40)
  • Form III – Agreement for voluntary arbitration (Rule 41)
  • Form IV – Authorization for representation before the authority under the Code (Rules 43, 62 & 63)
  • Form V – Oath of office for a Judicial or Administrative Member of the Tribunal (Rules 42(21) & 45(21))
  • Form VI – Application to the Tribunal for matters unresolved by the Conciliation Officer (Rule 46(4))
  • Form VII – Notice of strike by a union or group of workers (Rule 47)
  • Form VIII – Notice of lock-out by an employer (Rule 48)
  • Form IX – Notice of retrenchment or closure to the Jharkhand Government under Chapter IX (Rules 70(c), 49 & 51)
  • Form X – Application for permission of lay-off, continued lay-off, retrenchment, or closure to the Central Government under Chapter X (Rules 52, 54 & 56)
  • Form XI – Notice to an employer for a first-time offence, for compounding under Section 89(4) (Rule 59)
  • Form XII – Complaint under Section 91 of the Code (Rule 61)
