Haryana Draft Rules for the Industrial Relations Code
The Haryana government notified the Draft Rules for the Industrial Relations Code in the gazette on 16 September 2021.
Applicability
Once in force, the Draft Rules will apply across the whole of Haryana, for industrial establishments, undertakings, and matters where the State Government is the appropriate Government. They take effect from the date of final publication in the Official Gazette, following the commencement of the Industrial Relations Code, 2020.
Compliances
The Draft Rules prescribe twenty-two forms covering procedures under the Code:
- Form I – Memorandum of settlement reached during conciliation, or between employer and workers outside conciliation proceedings (Rule 3)
- Form II – Application for trade union registration (Rule 8)
- Form III – Certificate of trade union registration (Rule 10)
- Form IV – Register of trade unions (Rule 11)
- Form V – Annual returns (Rule 33)
- Form VI – Application for adjudication before the Tribunal under Section 22(1) of the Code (Rule 31)
- Form VII – Register of certified standing orders (Rule 42)
- Form VIII – Notice of an employer’s proposed change to service conditions (Rule 44)
- Form IX – Agreement for voluntary arbitration (Rule 45)
- Form X – Authorization for representation before the authority under the Code (Rules 47, 69 & 70)
- Form XI – Oath of office for an Administrative Member of the Industrial Tribunal (Rule 49)
- Form XII – Application to the Tribunal for matters unresolved by the Conciliation Officer (Rule 52)
- Form XIII – Application under Section 59(1) of the Code (Rule 53)
- Form XIV – Application by a person authorized by a worker, or by the assignee or heir of a deceased worker, under Section 59(1) (Rule 53)
- Form XV – Application under Section 59(2) of the Code (Rule 53)
- Form XVI – Application by an assignee or heir of a deceased worker under Section 59(2) (Rule 54)
- Form XVII – Notice of strike by a union or group of workers (Rule 54)
- Form XVIII – Notice of lock-out by an employer (Rule 55)
- Form XIX – Notice of retrenchment or closure to the State Government under Chapter IX (Rules 56 & 58)
- Form XX – Application for permission of lay-off, continued lay-off, retrenchment, or closure under Chapter X (Rules 59, 61 & 63)
- Form XXI – Notice to an employer for a first-time offence, for compounding under Section 89(4) (Rule 66)
- Form XXII – Complaint under Section 91 of the Code before the Conciliation Officer, Arbitrator, or Industrial Tribunal (Rule 68)
