Draft of Industrial Relation (Chhattisgarh) Rules, 2021

The Chhattisgarh government notified the Draft Rules for the Industrial Relations Code in the gazette on 25 May 2021.

Applicability

Once in force, the Draft Rules will apply across the whole of Chhattisgarh, for establishments and matters where the State Government is the appropriate Government, effective from the date of publication in the Official Gazette of Chhattisgarh. They will repeal three existing regulations:

  • Chhattisgarh Industrial Dispute Rules, 1957
  • Chhattisgarh Trade Unions Regulations, 1961
  • Chhattisgarh Industrial Employment (Standing Orders) Rules, 1963

Compliances

The Draft Rules prescribe thirty-two forms covering procedures under the Code:

  • Form I – Memorandum of settlement reached during conciliation, or between employer and workers outside conciliation proceedings (Rule 2)
  • Form II – Auditor’s declaration (Rule 8(7))
  • Form III – Notice of dissolution or amendment of a trade union’s rules (Rule 9(1))
  • Form IV – Application for trade union registration (Rule 10(1))
  • Form V – Affidavit accompanying a registration application (Rule 10(2))
  • Form VI – Register of trade unions (Rule 10(5))
  • Form VII – Certificate of trade union registration, issued by the Registrar of Trade Unions (Rule 10(6))
  • Form VIII – Request to withdraw or cancel a certificate of registration (Rule 10(7))
  • Form IX – Change in the officers of a registered trade union (Rule 12(2))
  • Form X – Change in the address of a trade union’s head office (Rule 12(2))
  • Form XI – Application for adjudication of a dispute before the Tribunal (Rule 15)
  • Form XII – Notice of amalgamation of trade unions (Rule 16(1))
  • Form XIII – Notice of change of name (Rule 16(1)(iii))
  • Form XIV – Annual returns (Rule 18(i))
  • Form XV – Application for recognition as a State-level trade union (Rule 19(1))
  • Form XVI – Notice of an employer’s proposed change to workers’ service conditions (Rule 29)
  • Form XVII – Agreement for voluntary arbitration (Rule 30(1))
  • Form XVIII – Authorization for representation before the authority under the Code (Rule 32)
  • Form XIX – Oath of office for a Judicial Member of the State Industrial Tribunal (Rule 33(21))
  • Form XX – Oath of office for an Administrative Member of the State Industrial Tribunal (Rule 34(21))
  • Form XXI – Application to the Tribunal for matters unresolved by the Conciliation Officer (Rule 35(5))
  • Form XXII – Notice of strike by a union or group of workers (Rule 36)
  • Form XXIII – Notice of lock-out by an employer (Rule 37(1))
  • Form XXIV – Notice of retrenchment to the State Government (Rule 38)
  • Form XXV – Notice of closure to the State Government (Rule 40)
  • Form XXVI – Application for permission of lay-off or continuation of lay-off, submitted 30 days before the lay-off or the end of the last lay-off (Rules 41 & 42)
  • Form XXVII – Application for permission of retrenchment, submitted 60 days before retrenchment (Rule 44)
  • Form XXVIII – Application for permission of closure, submitted 90 days before closure (Rule 46)
  • Form XXIX – Notice to an employer for a first-time offence, for compounding under Section 89(4) (Rule 49)
  • Form XXX – Complaint under Section 91 of the Code (Rule 51)
  • Form XXXI – Manner of authorization for a worker’s representation under Section 94 (Rule 52)
  • Form XXXII – Manner of authorization for an employer’s representation under Section 94 (Rule 53)
