The Kerala government notified the Draft Rules for the Code on Wages in the gazette on 15 December 2021.
Applicability
Once in force, the Draft Rules will apply across the whole State of Kerala, effective from the date following their final publication in the Gazette. They will repeal eight existing regulations:
- Kerala Payment of Wages (General) Rules, 1958
- Kerala Payment of Wages (Procedure) Rules, 1958
- Kerala Payment of Wages (Undisbursed Wages) Rules, 1998
- Kerala Payment of Wages (Procedure) Applications to Scheduled Employment Rules, 1964
- Kerala Payment of Wages (Unclaimed Amounts) Rules, 1958
- Kerala Payment of Wages (Manner of Recovery of Excess Deductions) Rules, 1968
- Kerala Payment of Wages (Deductions for National Defence Fund and Defence Savings Schemes) Rules, 1964
- Kerala Minimum Wages Rules, 1958
Compliances
The Draft Rules prescribe eight forms covering procedures under the Code:
- Form I – Register of wages and deductions (Rules 12 & 45(1), (2))
- Form I A – Register of wages and deductions (Rules 13 & 45(1), (2))
- Form II – Application under Section 45(5) before the authority appointed under Section 45(1) of the Code on Wages, 2019 (Rule 43)
- Form III – Appeal under Section 49(1) of the Code on Wages, 2019 before the Appellate Authority (Rule 44)
- Form IV – Wage slip (Rule 46)
- Form V – Muster roll (Rule 47)
- Form VI – Employee register (Rule 48)
- Form VII – Application under Section 56(4) for composition of offence (Rule 52)
