The Chhattisgarh government notified the Draft Rules for the Code on Wages in the gazette on 25 May 2021.
Applicability
Once in force, the Draft Rules will apply across the whole State of Chhattisgarh, effective from the date of their final publication in the Official Gazette. They will repeal two existing regulations:
- Minimum Wages (Chhattisgarh) Rules, 1958
- Chhattisgarh Payment of Wages Rules, 1962
Compliances
The Draft Rules prescribe nine forms, plus an annual return requirement, covering procedures under the Code:
- Form I – Employee register (Rule 33(3))
- Form II – Application under Section 45(5) before the authority appointed under Section 45(1) of the Code on Wages, 2019 (Rule 34(1))
- Form III – Appeal under Section 49(1) of the Code on Wages, 2019 before the Appellate Authority (Rule 34(3))
- Form IV – Register of wages, overtime, advances, fines, and deductions for damage or loss (Rules 11(2), 16 & 35(1))
- Form V – Wage slip (Rule 36)
- Form VI – Application under Section 56(4) for composition of offence (Rule 44(1))
- Form VII – Nomination form (Rule 35(4))
- Form VIII – Notice to the respondent, issued by the authority under Section 45(5) (Rule 37(4))
- Form IX – Attendance register cum muster roll (Rule 35(5))
Annual return: every employer covered by the Code must file this online with the area’s Inspector-cum-Facilitator, within the period and format the State Government prescribes, following the close of the financial year (Rule 39).
