The Rajasthan government notified the Draft Rules for the Code on Wages in the gazette on 14 July 2021.
Applicability
Once in force, the Draft Rules will apply across the whole State of Rajasthan, effective from the date following their final publication in the Official Gazette. They will repeal seven existing regulations:
- Rajasthan Payment of Wages Rules, 1961
- Rajasthan Payment of Wages (Procedure) Rules, 1961
- Rajasthan Payment of Wages (Unclaimed Amount) Rules, 1972
- Rajasthan Payment of Wages (Manner of Recovery of Excess Deductions) Rules, 1966
- Rajasthan Minimum Wages Rules, 1959
- Rajasthan Minimum Wages (Undisbursed Amount) Rules, 1961
- Rajasthan Ease of Compliance to Maintain Registers under Various Labour Laws Rules, 2017
Compliances
The Draft Rules prescribe eight forms covering procedures under the Code:
- Form I – Register of wages, overtime, fines, and deductions for damage or loss (Rules 18 & 42(1), (2), (3))
- Form II – Application under Section 45(5) before the authority appointed under Section 45(1) of the Code on Wages, 2019 (Rule 40)
- Form III – Appeal under Section 49(1) of the Code on Wages, 2019 before the Appellate Authority (Rule 41)
- Form IV – Employee register (Rule 42(3))
- Form V – Muster roll and overtime work details (Rule 42(3))
- Form VI – Notice (Rule 42(4))
- Form VII – Wage slip (Rule 43)
- Form VIII – Application under Section 56(4) for composition of offence (Rule 44)
