Draft of Code on Wages (Himachal Pradesh) Rules, 2021

The Himachal Pradesh government notified the Draft Rules for the Code on Wages in the Rajpatra (e-Gazette) on 7 July 2021.

Applicability

Once in force, the Draft Rules will apply across the whole State of Himachal Pradesh, effective from the date following their final publication in the Rajpatra. They will repeal four existing regulations:

  • Himachal Pradesh Payment of Wages Rules, 1979
  • Himachal Pradesh Payment of Wages (Procedure) Rules, 1979
  • Himachal Pradesh Minimum Wages Rules, 1978
  • Himachal Pradesh Ease of Compliance to Maintain Registers under Various Labour Laws Rules, 2020 — to the extent these were made under Sections 29 and 30 of the Minimum Wages Act, 1948, and Section 26 of the Payment of Wages Act, 1936

Compliances

The Draft Rules prescribe six forms covering procedures under the Code:

  • Form I – Register of wages, overtime, fines, and deductions for damage or loss (Rules 16 & 42)
  • Form II – Application under Section 45(5) before the authority appointed under Section 45(1) of the Code on Wages, 2019 (Rule 49)
  • Form III – Appeal under Section 49(1) of the Code on Wages, 2019 before the Appellate Authority (Rule 41)
  • Form IV – Employee register (Rule 42(3))
  • Form V – Wage slip (Rule 43)
  • Form VI – Application under Section 56(4) for composition of offence (Rule 44)
