Jharkhand Shops and Establishments Act, 2015

The Jharkhand Shops and Establishments Act, 2015 and its accompanying Rules, 2015 apply to all shops and commercial establishments across Jharkhand. The Act protects employees’ rights by regulating wage payment, terms of service, work hours, rest intervals, overtime, opening and closing hours, closed days, holidays, leave (including maternity leave and benefits), working conditions, the employment of children, and record-keeping.

Key Definitions

Establishment covers any business, trade, or profession, or any work connected with, incidental to, or ancillary to one. This includes:

  • Administrative or clerical services attached to such an establishment
  • Shops, restaurants, residential hotels, eating houses, theatres, or other places of public amusement or entertainment
  • Any other establishment the State Government notifies as covered by the Act

It excludes a “motor transport undertaking” as defined under Section 2(g) of the Motor Transport Workers Act, 1961.

Shop means any premises where goods are sold — retail or wholesale — or where services are rendered to customers. This includes offices, storerooms, godowns, warehouses, and workplaces connected to such sales or services, whether on the same premises or elsewhere. It excludes restaurants, residential hotels, eating houses, theatres, and other places of public amusement or entertainment.
