The Himachal Pradesh Shops and Commercial Establishments Act, 1969 and its accompanying Rules, 1972 apply to all shops and commercial establishments in areas notified by the Himachal Pradesh Government. The Act protects employees’ rights by regulating wage payment, terms of service, work hours, rest intervals, overtime, opening and closing hours, closed days, holidays, leave (including maternity leave and benefits), working conditions, the employment of children, and record-keeping.
Key Definitions
Commercial establishment means any premises where a business, trade, or profession operates for profit, including journalistic or printing establishments and premises used for banking, insurance, stocks and shares, brokerage, or produce exchange. It also covers hotels, restaurants, boarding or eating houses, theatres, cinemas, other places of public entertainment, and any other premises the Government notifies as a commercial establishment.
Establishment means a shop or a commercial establishment.
Shop means any premises where a trade or business operates, or where services are rendered to customers — including offices, storerooms, godowns, sale depots, or warehouses connected to that trade or business, whether on the same premises or elsewhere. It excludes commercial establishments and shops attached to a factory where employees already receive benefits under the Factories Act, 1948.
Registration
The employer of every establishment must submit a statement to the concerned Inspector, as required under Section 13, in Form No. 1, to register the establishment and obtain a registration certificate, along with the fee prescribed in Schedule I.
On receiving the statement and fees, and once satisfied the statement is correct, the Inspector registers the establishment in the Register of Establishments (Form No. 2) and issues the employer a registration certificate (Form No. 3).
