Sikkim Shops And Establishments Act

The Sikkim Shops and Establishments Act, 1983 and its accompanying Rules, 1984 apply to all shops and commercial establishments across Sikkim. The Act protects employees’ rights by regulating wage payment, terms of service, work hours, rest intervals, overtime, opening and closing hours, closed days, holidays, leave (including maternity leave and benefits), working conditions, the employment of children, and record-keeping.

Key Definitions

Commercial establishment covers any business, trade, or profession, or any work connected with, incidental to, or ancillary to one. This includes:

  • Societies registered (or deemed registered) under the Sikkim Co-operative Societies Act, 1978, and charitable or other trusts, registered or not, carrying on business, trade, or professional work
  • Establishments engaged in advertising, commission agency, forwarding, or commercial agency, or clerical departments of a factory or industrial or commercial undertaking
  • Insurance companies, joint stock companies, banks, and brokers’ offices and exchanges

It excludes factories, shops, residential hotels, restaurants, eating houses, theatres, and other places of public amusement or entertainment.

Establishment means a shop, commercial establishment, residential hotel, restaurant, eating house, theatre, or other place of public amusement or entertainment, along with any other premises the State Government notifies as an establishment.

Shop means any premises where goods are sold — retail or wholesale — or where services are rendered to customers. This includes offices, storerooms, godowns, warehouses, or workplaces connected to that trade or business, whether on the same premises or elsewhere. It excludes factories, commercial establishments, residential hotels, restaurants, eating houses, theatres, and other places of public amusement or entertainment.

Registration

  • Every establishment covered by the Act must register. Within thirty days of the Act applying to it, the employer sends the Chief Inspector a statement, in the prescribed form and with the prescribed fees, containing:
    • The name of the employer and manager, if any
    • The establishment’s postal address
    • The establishment’s name, if it has one
    • The category of establishment — shop, commercial establishment, residential hotel, restaurant, eating house, theatre, or other place of public amusement or entertainment
    • Any other prescribed particulars
  • On receiving the statement and fees, and once satisfied it’s correct, the Chief Inspector registers the establishment and issues the employer a registration certificate in the prescribed form. The certificate must be displayed prominently at the establishment.
  • The certificate is valid until the end of the year it’s granted for. Renewal applications must be submitted at least fifteen days before expiry, accompanied by the prescribed fee, and the renewed certificate follows the prescribed form.
  • If the employer and Inspector disagree about which category an establishment falls into, the matter goes to the Chief Inspector, whose decision — reached after whatever inquiry they consider appropriate — is final.
