The Manipur Shops and Establishments Act, 1972 and its accompanying Rules, 1973 apply to all shops and commercial establishments across Manipur. The Act protects employees’ rights by regulating wage payment, terms of service, work hours, rest intervals, overtime, opening and closing hours, closed days, holidays, leave (including maternity leave and benefits), working conditions, the employment of children, and record-keeping.
Key Definitions
Commercial establishment covers businesses, trades, or professions in advertising, commission agency, forwarding, or commercial agency, as well as clerical departments of a factory or industrial or commercial undertaking. This includes:
- Public transport businesses
- Insurance companies, joint stock companies, brokers’ offices, or exchanges
- Any other establishment the State Government notifies as a commercial establishment
It excludes shops and establishments for public entertainment or amusement.
Establishment means a commercial establishment or an establishment for public entertainment or amusement.
Establishment for public entertainment or amusement means a restaurant, eating house, café, residential club, cinema, theatre, or any other premises the State Government notifies as such. It excludes shops and commercial establishments.
Shop means any premises used wholly or partly for wholesale or retail sale of commodities or articles, for cash or credit, along with any other premises the State Government notifies as a shop. It excludes commercial establishments and establishments for public entertainment or amusement.
Registration
- Within thirty days of these Rules taking effect (17 March 1997), for shops and establishments already operating on that date — or within thirty days of starting business, for new ones — the employer must apply for registration to the Registering Officer, or an officer they’ve authorized, using Form IX in duplicate, along with the original Treasury challan for the fee specified in Schedule I.
- On receiving the application and fee, and once satisfied the particulars are correct, the Registering Officer registers the shop or establishment and issues a certificate of registration in Part II of Form IX.
