The Payment of Gratuity Act,1972

An Act to provide a scheme for the payment of gratuity to employees engaged in factories, mines, oilfields, ports, plantations, shops, or other establishments, and for matters connected with or incidental to it.

Applicability

  • Every factory, mine, oilfield, plantation, port, and railway company.
  • Every shop or establishment (as defined under the applicable state law on shops and establishments) where 10 or more persons are employed, or were employed, on any day in the preceding 12 months.
  • Any other establishment or class of establishment employing 10 or more people on any day in the preceding 12 months, as notified by the central government.
